Terms of Use Last Updated: June 1, 2026 These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and the Aura Spell team ("we", "our"), governing the use of the Aura Spell application. By using Aura Spell, you represent that you have read, understood, and accepted these Terms. 1. Service Description and Purpose Aura Spell is a relationship and social assistance application powered by artificial intelligence (AI, via Google Gemini) that provides communication suggestions, "pickup lines", ice-breakers, and interaction tips, and also allows users to connect and chat with each other through private chat. The Service includes features such as message generation in different modes and categories, the Enigma Mode (approach suggestions based on the conversation history) and the Consultant Mode (step-by-step approach plans). All AI-generated suggestions are intended for entertainment and personal development. 2. Eligibility and Registration Minimum age: access to Aura Spell is restricted to individuals aged 16 or older.; User accounts: when creating an account, the User agrees to provide accurate information and is entirely responsible for maintaining the confidentiality of their access credentials.. 3. Artificial Intelligence Disclaimer The User acknowledges and agrees that: Nature of responses: AI-generated responses are based on statistical patterns and language models and may contain inaccuracies, factual errors, or suggestions inappropriate for specific contexts.; Individual responsibility: the User is solely responsible for evaluating and deciding whether to use the suggestions provided. Aura Spell is not responsible for the User's real-world social interactions, including but not limited to rejections, conflicts, misunderstandings, or emotional harm.; No warranties: Aura Spell does not guarantee any specific outcome, success in dating, romantic conquests, or guaranteed improvement in social communication.. 4. Prohibited Use and Content Moderation (UGC) It is strictly prohibited to use Aura Spell to: engage in harassment, bullying, stalking, or any form of abuse against third parties;; generate deceptive content for fraud or the creation of false identities (catfishing);; engage in spam or violate the terms of use of third-party applications (such as Tinder, Hinge, or Instagram);; enter or generate content that promotes violence, hate, discrimination, or illegal activity.. Zero tolerance. Aura Spell adopts a policy of zero tolerance for objectionable content and abusive users. By using the application, the User agrees not to post, send, or generate objectionable content and not to engage in abusive behavior against other users. Safety tools. The application provides, within the app, mechanisms for the User to report offensive content or behavior and to block other users at any time. Response commitment. We are committed to reviewing reports of objectionable content or abusive behavior and to acting within 24 hours, removing the flagged content and/or suspending or banning the responsible user, depending on severity. We reserve the right to suspend or terminate accounts that violate these rules, using automated moderation systems and human review. Moderation contact. Subscriptions and Financial Terms (Freemium Model) Aura Spell offers premium features through auto-renewable subscriptions ("Aura Pro"). Payment methods: payments are processed via credit card (including Apple Pay), through Stripe, and via PIX, through Mercado Pago. We do not store your full card data.; Automatic renewal: subscriptions may renew automatically at the end of each billing period (monthly, quarterly, annual, or as per the contracted plan), unless canceled before the end of the current period.; Management and cancellation: the User can manage and cancel subscriptions in the app settings. When the purchase is made through the app store, management can also be done in the Apple App Store or Google Play Store.; Refund request: the User may request a refund directly in the app settings, stating the reason. The request is subject to approval and must be made within 8 days of purchase.. 6. Account Deletion In compliance with Apple and Google requirements, Aura Spell provides an external, public option for the User to request the permanent deletion of their account and all associated personal data, subject to legal data-retention obligations. The official request flow is available at /legal/excluir-conta/ and requires prior authentication, plus additional confirmation by typing the registered email, to prevent accidental or unauthorized deletions. After the request, deletion remains pending for 72 hours, during which the User may cancel the request through the same flow. Once this period ends, the account is anonymized and identifiable personal data is removed, with only the records that must be retained by legal or security obligation remaining. 7. Limitation of Liability To the maximum extent permitted by law, Aura Spell and its licensors shall not be liable for indirect, incidental, or consequential damages arising from the use of the app or reliance on AI suggestions. 8. Application License (EULA) and the App Store When Aura Spell is obtained through the Apple App Store, this section constitutes the End-User License Agreement (EULA) between you and Aura Spell, supplementing the other Terms above. Parties to the agreement: this EULA is entered into solely between you and Aura Spell (the developer), and not with Apple. Apple is not a party to this agreement and is not responsible for the application or its content.; Scope of license: we grant you a personal, limited, non-transferable, non-exclusive license to use Aura Spell on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.; Maintenance and support: the developer is solely responsible for providing maintenance and support for the application. Apple has no obligation whatsoever to furnish any maintenance and support services.; Warranty: the developer is solely responsible for any product warranties, whether express or implied. In the event the application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple will have no other warranty obligation.; Product claims: the developer, not Apple, is responsible for addressing any claims by you or any third party relating to the application, including product liability, failure to conform to legal or regulatory requirements, and consumer protection matters.; Intellectual property: in the event of any third-party claim that the application infringes their intellectual property rights, the developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.; Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.; Developer contact: questions, complaints, or support requests regarding the application should be directed to berskytech@auraspell.app.; Third-party terms: when using the application, you must comply with applicable third-party terms of agreement.; Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of these Terms, will have the right to enforce this EULA against you.. 9. Privacy Policy

Privacy Policy: Aura Spell Last Updated: June 1, 2026 We at Aura Spell are committed to protecting your privacy and processing your personal data with transparency, as required by the Brazilian General Data Protection Law (LGPD) and the General Data Protection Regulation (GDPR). 1. Data Collected and Purpose We collect the following categories of data to ensure the app works and to improve our services: Registration data: email, name, username (aura name), phone, sex, marital status, intended use, and optionally a profile photo. Used for authentication, account management, and the operation of connections between users.; CPF (Brazilian tax ID): when you choose to pay via PIX, we validate the provided CPF with a verification service to process the payment. The CPF is not used for any other purpose.; Chat messages and media: messages exchanged between connected users are stored encrypted (AES-GCM) in our database. Images and files sent in chat are temporarily stored in a storage service (Cloudflare R2) and expire automatically after the configured period.; Content sent to the AI: when you request the generation of a pickup line/message or use the Enigma and Consultant modes, excerpts of the conversation history are sent to the AI provider to generate the response. Before sending, we apply sanitization that removes contact data (emails and phone numbers) from the text.; Payment and subscription data: records of payments, subscriptions, coupons, and refunds. Card data is processed directly by the payment providers — we do not store card numbers on our servers.; Push notification tokens: device identifiers (via Firebase Cloud Messaging) for sending notifications.; Technical data: IP address, operating system, and device model for security and error-diagnosis purposes.. 2. Sharing with Third Parties and AI We use third-party providers strictly to operate the service: AI provider — Google Gemini: the message generation, Enigma Mode, and Consultant Mode features use the Google Gemini API. To generate responses, excerpts of the conversation history (after sanitization that removes emails and phone numbers) are transmitted to Google for processing. We do not authorize the use of this data for the provider's own purposes beyond processing the request.; Payment processors — Stripe and Mercado Pago: data required to process payments (card via Stripe/Apple Pay; PIX via Mercado Pago) is handled directly by these providers.; Storage — Cloudflare R2: profile photos and chat attachments are stored in this service.; Notifications — Firebase Cloud Messaging (Google): used to deliver push notifications.; No sale of data: we do not sell your data for advertising purposes, nor do we share sensitive data (racial origin, religious belief, health data) with third parties for marketing purposes.. 3. Data Subject Rights (LGPD/GDPR) You have the right to: confirm the existence of processing and access your data;; correct incomplete, inaccurate, or outdated data;; request the anonymization, blocking, or deletion of unnecessary data;; withdraw your consent at any time;; request the full deletion of the account and data through the external deletion flow available at /legal/excluir-conta/.. When deletion is requested, the account remains pending for 72 hours to allow the request to be canceled. After this period, identifiable personal data is anonymized and only records subject to legal or security retention are preserved. 4. Data Security We employ strict technical and administrative measures to protect your data against unauthorized access and accidental or unlawful destruction, loss, or alteration. Chat messages are encrypted (AES-GCM) at rest in the database.; Communication between the app and our servers occurs over an encrypted connection (HTTPS/TLS).; Administrative access to data is restricted and audited.. 5. Data Retention We keep your personal data only for the period necessary to fulfill the purposes described in this policy or to meet legal requirements: Registration data and messages: kept while the account is active; removed/anonymized after account deletion (see item 3).; Chat images and attachments: stored temporarily in storage and expire automatically after the configured period (currently about 5 days). The copy you downloaded to your device remains under your control.; Connection logs: retained for 6 months, in accordance with the Brazilian Civil Rights Framework for the Internet (Law No. 12,965/14).; Financial records: retained for the period required by tax and fraud-prevention legislation.. 6. International Transfer Your data may be processed on servers located outside Brazil or the European Union. We ensure that such transfers occur only to countries that offer an adequate level of protection or through the use of standard contractual clauses. 7.
